first of all, by 'getting kernal mode' that is accessing it ..

1 - Generally no
2 - Probably neither
3 - Probably not
4 - That doesnt really make sense. The kernel as such is like... a memory card which stores all the firmware information on it, which is like the operating system. So each version will need a seperate way to access the kernel through an exploit, unless the exploit works on the higher versions.
5 - it will be loaded however we can get access.

I dont think you really have an understanding of what it is
