That's a load of bull crap. If you can see what someone is uploading, it is 10 times easier to see what they are downloading. And encryption? Hell yes. It can be cracked, and brought to court as evidence against you. Oh, and the open wifi thing? Guess what! LIES! The only reason that case got away with it is because the guy was able to
prove that it wasn't him though the log files on his router. Those same log files were used in another case against someone who was file sharing.
Here's a simple rule to remember about file sharing: There is no such thing as untracible file sharing. I help monitor the network at a my old highschool from my own computer 300 miles away. Without knowing anything more then the i.p. address range of the school computers, I can figure out who was looking at what, when, and from which computer (I'm just looking for the people who try to look at porn, but I've identified computers filesharing and ones that were connected to botnets). If I can do that, then the true pros at the RIAA can do far more when it comes to figuring out your surfing habits and what you are sharing.
Next time, don't just listen to some idiot on youtube, and ask your nearest computer guru. He'll tell you exactly what I am saying now.

P.P.P.S. 2 students at UCSD were sued last year for sharing one file. That's right, just one file.
