Many sites have claimed that Limewire and Kazaa are not illegal since the music has been bought by the individual who is sharing it but they also state that things like music that has been copied from the radio or copied music is piracy. Does anyone know if this is true? I don't really want to break the law...

-downloading copyrighted content is ILLEGAL, unless you already own the file(s)
-sharing copryrighted content is ILLEGAL
-recording from a radio station/podcast is legally disputed as it has been freely distributed with the copyright holders permission.

Points: 21.55 Donate | | | P2P Is all completely legal downloading copyrighted material is completely legal, as long as you own the original artical (I.E Wanted as a backup) or the material is release by the original owner as free, the only time it is illegal is when you dont own the original or the original owner doesn't wish it to be shared

Points: 21.55 Donate | | | actually i think downloading\recording a song from radio would be classed as illegal, because your still stealing from the artist of the song, unless of course you have bought the original. although you might be allowed to download it for sampling reasons as long as you delete once sampled or you bought the original after

You're not buying the song, you're buying a licence for a song. That means you can only play the song in the comfort of your own home (if you check your CD / DVD cases it applies to both music and videos). Radio stations have special licences which lets them use music over radio! It also explains why department stores play the same crap over and over, and why your bank always puts you on hold with "green sleeves". They buy the licence for one song for public use. My old work had to apply for a public licence just to play music in store. Still, most people don't give a shit and do it anyway.. It's not like they're going to sue an individual person for downloading 1 song.
In effect, by law you can actually only have one copy of the song which also makes backups illegal, but people do it anyway...
P2P programs are the best places to get caught downloading MP3s though.. So if you want to get caught, those are your best chances.. Because it's P2P you have to contribute back most of the time, and contributers are the people who more frequently than not get stung by the fuzz. | |
